Visto el auto del 11/07/2013 y por cuanto se observa que por error material involuntario, específicamente el Titulo II numeral 3 (Hechos no Controvertidos), se plasmo que la Hipoteca Convencional de Primer Grado a favor de la entidad financiera, fue constituida por la Sociedad Mercantil LAS 10 CABAÑAS C.A., siendo lo correcto la constitución de dicha hipoteca por el ciudadano J.H.M.D., Colombiano, mayor de edad, titular de la Cédula de Identidad Nº E-81.536.834; a los fines de garantizar el principio de la seguridad Jurídica de las partes que debe estar presente en todo proceso y en aras de garantizar la Tutela Judicial Efectiva contenida en el Artículo 26 de la Constitución de la República Bolivariana de Venezuela, es deber de este Órgano Jurisdiccional corregir el error material indicado en el presente auto, el cual no debe ser entendido como una modificación sustancial del mismo, por lo cual en donde se estableció “LAS 10 CABAÑAS C.A.”, lo correcto es que debe leerse “JAIME H.M.D., Colombiano, mayor de edad, titular de la Cédula de Identidad Nº E-81.536.834”, en consecuencia se subsana el error material en que se incurrió en el referido auto.
