Visto el escrito presentado por diligencia en fecha 20 de julio de 2010, por la abogada Eillen Rodríguez, inscrita en el Instituto de Previsión Social del Abogado bajo el Nº 86.537, actuando con el carácter de representante de la ciudadana Procuradora General de la República, mediante el cual promueve pruebas en la demanda interpuesta por el ciudadano J.R.B.V., contra la República Bolivariana de Venezuela, por órgano del Ministerio de la Defensa y el ciudadano J.M.A.G., por indemnización por daños y perjuicios; este Juzgado, siendo la oportunidad de su admisibilidad, pasa a decidir en los siguientes términos:
Se admiten cuanto ha lugar en derecho por no ser manifiestamente ilegales ni impertinentes, salvo su apreciación en la sentencia definitiva, las documentales indicadas en los Capítulos I y III (identificado por la promovente como Capítulo IV) del escrito de promoción de pruebas, los cuales se contraen a reproducir el mérito favorable de los autos, así como también las documentales producidas en el Capítulo II del mencionado escrito; y, por cuanto dichos documentos cursan en autos, manténganse en el expediente.
Visto el pronunciamiento respecto a la admisión de las pruebas promovidas, este Juzgado ordena notificar a la ciudadana Procuradora General de la República, a tenor de lo dispuesto en el artículo 86 del Decreto con Rango, Valor y Fuerza de Ley de Reforma Parcial del Decreto con Fuerza de Ley Orgánica de la Procuraduría General de la República. Líbrese oficio, remitiéndole a dicha funcionaria copia certificada de las decisiones de admisión de pruebas.
