Resumen
La violencia sexual es un delito que se encuentra contemplado en los artícu-
los 43 y 44 de la Ley Orgánica sobre los Derechos de las Mujeres a una Vida Libre
de Violencia. Este artículo tiene como objetivo principal analizar las diversas formas
de consumar el delito y determinar las pruebas necesarias para establecer la res-
ponsabilidad penal del agresor, entre ellas: 1) La declaración de la víctima, 2) la
prueba ginecológica emitida por los médicos(as) forenses y 3) las sentencias dicta-
das en los últimos años con respecto al delito. La metodología utilizada es la docu-
mental. Se concluye que la prueba ginecológica aportada por los(as) médicos(as) fo-
renses, puede demostrar que se produjo un acceso carnal, con las especificaciones
de las distintas lesiones, ya sean en la zona vaginal o anal.
