RESUMEN
La investigación tiene por objetivo analizar la denegatoria de beneficios penitenciarios
por delitos de tráfico ilícito de drogas en el Establecimiento Penitenciario de Mujeres de
Chorrillos, ubicado en la provincia de Lima –Perú. Metodológicamente fue de tipo
documental descriptiva con diseño bibliográfico no experimental, teniéndose un
acercamiento exploratorio con la realidad social del Establecimiento Penitenciario de
Mujeres de Chorrillos, ubicado en la provincia de Lima – Perú. Los beneficios
penitenciarios son estímulos al tratamiento y al régimen penitenciario que tiene por objeto
la reeducación, rehabilitación y reincorporación del penado a la sociedad. siendo que
para cumplir tan importante finalidad tanto el INPE, el Ministerio Público y el órgano
jurisdiccional deben de adoptar las medidas necesarias que hagan que el Estado no sea
un simplemente aplicador de las teorías absolutas de la pena retribucionismo puro, sino
que se debe propender a la resocialización, teorías preventivo especiales positivos de la
pena.

ABSTRACT
The objective of the investigation is to analyze the denial of prison benefits for crimes of
illicit drug trafficking in the Chorrillos Women's Penitentiary Establishment, located in the
province of Lima - Peru. Methodologically, it was of a descriptive documentary type with
a non-experimental bibliographic design, having an exploratory approach with the social
reality of the Chorrillos Women's Penitentiary Establishment, located in the province of
Lima - Peru. The penitentiary benefits are stimuli to the treatment and the penitentiary
regime that aims at the reeducation, rehabilitation and reincorporation of the prisoner into
society. being that in order to fulfill such an important purpose, both the INPE, the Public
Ministry and the jurisdictional body must adopt the necessary measures that make the
State not simply an application of the absolute theories of pure retributionism, but that it
must tend to resocialization, positive special preventive theories of punishment.
