Resumen: En el e jercicio de sus funciones los árbitros podrían cometer errores e
incumplimientos. A la vez que, la parte perdidosa del procedimiento, o incluso ambas
partes, podrían quedar insatisfechas con el contenido del l audo e intentar canalizar su
disconformidad mediante acciones dirigidas directamente contra el árbitro. Por ello, el
estudio de la responsabilidad civil del árbitro es de gran importancia. Sin embargo, en
el derecho venezolano no exi ste una normativa legal específica que la regule, ni
criterios jurisprudenciales que desarrollen esta materia. En est e contexto, el presente
trabajo hace un análisis crítico de la normativa legal venezolana que regula el tema de
la responsabilidad civil general, a la luz de la especial naturaleza jurídica de la función
jurisdiccional de ori gen contractual que cum ple el árbitro, en aras de determinar los
alcances de su responsabilidad civil y los requisitos que se deben cumplir para hacerla
efectiva.

Abstract: In the exe rcise of their functions, arbitrators coul d commit errors and
breaches. At the same time, the losing party of the procedure, or even both parties,
could be dissatisfied with the content of the award and try to channel their disagreement
through actions directed directly against the arbitrator. Therefore, the study of the civil
liability of the arbitrator is of great importance. However, in Venezuelan law there is
no specific legal regulation that re gulates it, nor jurisprudential criteria that develop
this matter. In this context, the present work makes a critical analysis of the Venezuelan
legal regulations that regulate the subject of general civil liability, in light of the special
legal nature of the jurisdictional function of contractual origin that the arbitrator
