Nueva Ley Orgánica de Amparo a la Libertad y Seguridad Personal

Esta Ley derogó expresamente el Título V de la Ley Orgánica de Amparo sobre Derechos y Garantías Constitucionales (“Ley de Amparo”) y, en consecuencia, introdujo en el ordenamiento jurídico venezolano una ley que regula y desarrolla específicamente la acción que persigue garantizar la eficacia material del derecho constitucional de todo ciudadano al amparo a su libertad y seguridad personal. En efecto, la Ley tiene por objeto garantizar a toda persona, sin discriminación alguna, la protección, respeto, goce y ejercicio de los derechos humanos y garantías constitucionales a la libertad y seguridad personal, a través de la acción de amparo constitucional.
¿Contra qué actos procede el Amparo a la Libertad y Seguridad Personal?
La acción de amparo a la libertad y seguridad personal procede contra cualquier hecho, acto u omisión proveniente de los órganos y entes del Poder Público – ya sea del Poder Público Nacional, Estadal o Municipal – o de personas naturales y jurídicas, que implique una amenaza grave e inminente o una violación, privación o restricción a estos derechos que sea arbitraria o contraria al ordenamiento jurídico.
¿Quién puede ejercer una acción de Amparo a la Libertad y Seguridad Personal?
La acción de amparo a la libertad y seguridad personal podrá ser ejercida directamente por la persona agraviada o por cualquier persona, sin la necesidad de asistencia de un abogado. También podrá ser presentada por la Defensoría del Pueblo o por el Ministerio Público. Un elemento novedoso...
