RESUMEN
El objetivo de la investigación fue analizar la prisión preventiva como medida cautelar
en América Latina y sus efectos en el derecho a la libertad y la presunción de
inocencia. Se basó en la revisión bibliográfica - documental de los diferentes artículos
indexados en revistas nacionales e internacionales como: Scielo, Redalyc y Dialnet.
Al aplicar esta medida se produce un incremento de personas detenidas sin tener una
sentencia ejecutoriada, estando a la espera la misma; considerando este particular se
produce un incremento en las cárceles de los países causando una sobrepoblación
penitenciaria con consecuencias, tales como: violencia dentro de las cárceles o la
imposibilidad de una reinserción social de las personas detenidas.

ABSTRACT
The objective of the research was to analyze pretrial detention as a precautionary
measure in Latin America and its effects on the right to liberty and the presumption of
innocence. It was based on the bibliographic-documentary review of different articles
indexed in national and international journals such as: Scielo, Redalyc and Dialnet. By
applying this measure, there is an increase in the number of people detained without
having an enforceable sentence, while waiting for it; considering this particular, there
is an increase in the prisons of the countries causing an overpopulation of prisons with
consequences such as: violence inside the prisons or the impossibility of a social
reintegration of the detainees.
