RESUMEN
La convención de los derechos del niño ha generado un nuevo paradigma entorno a
materia de infancia a nivel mundial, en esta investigación se examinó la efectividad de la
norma legal del apremio personal en relación con la garantía constitucional del principio
del interés superior del niño y su aplicación por los operadores de justicia en el cantón
Cuenca. El método fue no experimental de tipo mixto y se empleó un análisis inductivo-
deductivo en combinación con un estudio documental jurídico para analizar los discursos
relacionados con el interés superior del niño como garantía constitucional. Queda
demostrado que una medida punitiva como la del apremio personal por adeudar
alimentos, puede ser superada en su eficacia jurídica, por decisiones concomitantes a la
del cobro de lo adeudado, proporcionadas por una lectura más extensa y profunda del
CNA (2003) y normas conexas.

ABSTRACT
The convention on the rights of the child has generated a new paradigm around childhood
matters worldwide, this research examined the effectiveness of the legal norm of personal
constraint in relation to the constitutional guarantee of the principle of the best interests of
the child and its application by justice operators in Cuenca canton. The method was non-
experimental of a mixed type and an inductive-deductive analysis was used in
combination with a legal documentary study to analyze discourses related to the best
interests of the child as a constitutional guarantee. It is demonstrated that a punitive
measure such as that of personal compulsion to owe food, can be surpassed in its legal
effectiveness, by concomitant decisions to that of collection of the debt, provided by a
more extensive and in-depth reading of the ANC (2003) and related norms .
