RESUMEN
Se tiene por objetivo analizar cómo aplicar la teoría del delito en el sistema procesal
penal acusatorio. Se trabajó con una metodología de tipo descriptiva documental con
un diseño bibliográfico, lo que permitió investigar en fuentes bibliográficas y jurídicas,
permitiendo articular un cuerpo reflexivo teórico como aporte al fortalecimiento del
estado del arte del derecho. Entre los principales aportes se presenta que todo lo
manifestado en líneas precedentes, podremos colegir que en el sistema adversarial en
el campo del litigio del juicio-, si no se tiene una estrategia previamente elaborada, no
se podrá llegar a un objetivo específico; pues el improvisar la defensa en el momento,
nos llevaría a la mediocridad, desnaturalizando nuestra misión de abogado. Es muy
difícil, en audiencia de juicio, poder escoger en ese momento la dogmática penal a
implementar; interrogar sin conocer las respuestas y plantear alegatos sin saber que
queremos demostrar.

ABSTRACT
The objective is to analyze how to apply crime theory in the accusatory criminal
procedure system. We worked with a methodology of descriptive documentary type with
a bibliographic design, which allowed research in bibliographic and legal sources,
allowing to articulate a theoretical reflective body as a contribution to the strengthening
of the state of the art of law. Among the main contributions it is presented that
