Conclusiones
El instrumento que llamamos «proceso» no puede ni debe servirse de
mecanismos que limiten las libertades. Institucionalizar el temor a ser san-
cionado es nefasto para el correcto ejercicio de los derechos y las garantías
fundamentales563. Cuando por norma o tendencias se regulan y aceptan
instrumentos genéricos y sin límites que prometen sanciones, p. ej., por
no decir la verdad, ser excesivamente «litigioso» en la defensa, no cola-
borar con la justicia, ser desleal o improbo, y en denitiva, el violar al-
guno de los deberes que se derivan del principio de moralidad procesal,
se avanza hacía sistemas procesales que limitan la actividad de defensa.
Limitaciones, que, a nuestra manera de ver, resultan en la mayoría de los
casos poco razonable en el contexto donde operan: El proceso, donde dos
partes se enfrentan en debate dialéctico564.
