Introito
En el año 2022, se tuvo noticia de un Proyecto de ley que se refería a la
tutela1. Desde ese momento se propuso la idea de preparar una obra que
comentara los diversos aspectos asociados a la referida institución, todo
ello con la intención de ofrecer aportes a la discusión del instrumento.
Aunque el plan inicial era preparar un libro colectivo invitando a varios
amigos de la Cátedra Dra. María Candelaria D G a co-
laborar, las complicaciones de agenda dicultaron el éxito de tal empresa
y, por ello, en este menudo vademécum que el lector tiene ante sus ojos,
solo encontrará una pequeña muestra de aquel propósito inicial.
En tal sentido, la obra se dividió en tres partes: la primera, en la cual se
comenta la tutela de menores de edad en su regulación actual efectuada
por el Código Civil y los demás instrumentos que la rigen, trabajo que se
extrae de nuestras Lecciones impartidas en la Universidad Central de Ve-
nezuela en la Cátedra Derecho Civil Personas –con las respectivas actua-
lizaciones y ampliaciones– y, de seguida, como segunda parte, un trabajo
inédito en el cual se examina el texto del Proyecto de Ley de Tutela Civil
de 2022 y sobre el cual se efectúan comentarios, críticas y concordan-
cias, además de aderezar las reexiones con una comparación exegética de
la legislación foránea en materia de tutela –en concreto se examinan los
códigos civiles de Argentina2 y España3 en sus recientes reformas–, esto
