El Derecho Civil patrimonial jamás perderá vigencia, porque, aunque se
insista en subestimar la materia, nadie puede vivir sin un mínimo de lo
material. Las cosas, los bienes y el patrimonio siempre estarán en la vida
o existencia jurídica de la persona, porque esta las precisa para su subsis-
tencia. De allí que se deseche la idea de una «despatrimonialización del
Derecho Civil».
Se arma entonces que, «si se concibe el patrimonio como un medio para
el logro de las nalidades más inmediata s de la personalidad, se comprende
la íntima y estrecha ligazón que existe entre persona y patrimonio, entre las
que no es posible una separación tajante. Por ello, es absolutamente impo-
sible una despatrimonialización del Derecho Civil, que dejaría desasistida
una de las manifestaciones más importantes del derecho humano»1.
Así, admitiendo que lo más importante siempre será la persona, ello no
desmerece el estudio de las cosas, los bienes o el patrimonio. Pues bien,
se arma que «El Derecho Civil no actúa por y para el patrimonio, sino
a través del patrimonio»2. Precisamente, al estudio de tales se dirige la
investigación que presentamos.
El -19 nos permitió evocar el viejo dicho de que «no hay mal que
por bien no venga» o, para no ser tan radical, en su enfoque positivo di-
ríamos que, en razón de las circunstancias, nos permitió dedicar buena
parte del tiempo de connamiento a un proyecto que comenzamos juntos
hace aproximadamente cuatro años.
